Terms of Service

1. General info
▶️ 1.1 A client automatically agrees to the following Terms of Service by sending me the requested amount of money. Client must also confirm that he has read, understands and agrees to the Term of Service using any of the provided means of contacting me.
▶️ 1.2 I preserve the right to change Terms of Service and commission prices at any time. I will post information about ToS changes on my sites. A client is always bond under the version of Terms of Service he/she agreed to from the day he/she sent payment for commission.
▶️ 1.3 A client acknowledges the fact that each artist has his/her own style of drawing and is OK with the fact that a character’s appearance can be influenced by the artist’s style.

2. Contact
▶️ 2.1 Valid contact methods are Telegram (@redizak), Discord (@redizak) and e-mail ([email protected]).
▶️ 2.2 I can speak fluently English and Polish. I refuse to work with people who do not speak at least one of those languages.
▶️ 2.3 Telegram and Discord is my preferred method of discussing commissions.
▶️ 2.4 All information on my current commission status, YCH’s and other artistic activity can be found on my FurAffinity/Twitter/Bsky page. Please don’t send me questions about my commission status.

3. General ordering rules
▶️ 3.1 Current price list for each type of art I can draw can be always found on my FurAffinity page.
▶️ 3.2 I open for commissions regularly, usually taking 3-4 commissions a month.
▶️ 3.3 If you order a commission you will be put in a small queue. I don’t plan commissions more than a few months ahead.
▶️ 3.4 When discussing commission for the first time I will inform You when I plan to start working on it. I will also notify You a few day before I start working on the commission.
▶️ 3.5 All orders must be made using contact methods described in point 2.1. I can refuse orders made via other contact methods.
▶️ 3.6 All orders must be written in languages described in point 1.
▶️ 3.7 I can have questions about the commission order that I will send back to the client. I won’t start working on a drawing unless all my questions are answered and I reach an agreement with the client.
▶️ 3.8 If client requests a specific deadline for a commission, that deadline must be set before drawing process begins.
▶️ 3.9 If a client commissions me regularly I can start giving the special discounts for next commissions. Please contact me for details.

4. Standard commission ordering rules
▶️ 4.1 A client is obliged to provide an extensive description of a commission. I need at least a general idea about the commission topic, included characters, action and scenery. The more info is provided at start the less questions I will have later.
▶️ 4.2 A client takes responsibility for all mistakes I could make caused by client providing wrong references or incorrect commission details.
▶️ 4.3 In case a client cannot provide a reference sheet for a character a detailed description of a character’s appearance is required. Please be informed that in such case I won’t dedicate as much time into designing a character appearance. A client should be aware that a character drawn from a description for a commission may vary from client’s imagination of that character.
▶️ 4.4 If a client does not have the rights to every character ordered in a commission he/she is obliged to specify the rights owner of each character. I will contact each character owner to verify whether that person has no problems with using their characters in a commission. I won’t start working on a commission unless all character owners will accept the commission.
▶️ 4.5 Only exception from paragraph 4.4 2is a situation when client can prove that he/she knows closely all people whose characters are used in the commission. In such case client agrees to take full responsibility for use of other people’s characters in the commission.
▶️ 4.6 If one commission is ordered by multiple people then I will only discuss commission info with one representative from that group. Such commission is treated as being ordered only by one commissioner (being the group’s representative) who accepts to be fully responsible for the order during whole commission process.

5. YCH specific ordering rules
▶️ 5.1 Every YCH will be held only on one of my pages like FurAffinity/Twitter/Bsky.
▶️ 5.2 Bidding is possible only under the YCH announcement as a reply to a comment made by me where I specify the character slot that is being bided. I don’t count bids made via any other methods.
▶️ 5.3 I may restrict types of characters allowed by categories like species, gender or colour. I preserve the right to refuse a bid if client’s character does not meet the YCH’s requirements.
▶️ 5.4 If client is unsure about his character fitting the YCH character requirements, he/she can always ask me before making a bid.
▶️ 5.5 I will post any other YCH specific rules not mentioned in Terms of Service in the YCH announcement.
▶️ 5.6 Client must be able to provide a reference sheet for a character. In case of YCH I don’t allow for characters that have only descriptions of their appearance.
▶️ 5.7 I preserve the right to remove any comment from the bidding thread that is not a bid.
▶️ 5.8 A client who won an YCH can resign from it as long as I haven’t started the shading process of his/her character. In such case the slot will be given to the next person who had the highest bid for that slot. If there would be no other interest for that slot I can announce a new bidding for that slot or fill it with a character of my choice.

6. Payment
▶️ 6.1 All my prices are presented in EURO.
▶️ 6.2 Client can pay in USD equivalent of Specific EURO sum shown in price list
▶️ 6.3 I accept only PayPal payments.
▶️ 6.4 All payments are requested by in invoice. I only send invoice when I’m about to start working on your commission, not sooner.
▶️ 6.5 A client must provide a PayPal email address in order to receive an invoice.
▶️ 6.6 I prefer to have whole commission paid upfront. I might allow to split payment into 2 instalments.

7. Refunds
▶️ 7.1 There are no refunds in case of paying in 2 instalments. All info below is valid only for a full upfront payment.
▶️ 7.2 A client can order a refund at any time during the creative process without specifying the reason for a refund.
▶️ 7.3 The amount of the refund will be calculated based how advanced the creative process is. Refund values are described in table below.

▶️ 7.4 I reserve the right to cancel a commission at any time for any reason especially due to bad communication, client’s rude behaviour, misunderstanding of my Terms of Service or for private reasons. In such case the client will receive a refund according to Table 1 based on how advanced the drawing was the day I send a message about commission cancellation.
▶️ 7.5 Client acknowledges and agrees the fact that in case of a refund I preserve the right to use the background and character poses in any other drawing or as a base for a YCH drawing.

8. General artistic pipeline
▶️ 8.1 The creative process starts with client ordering a drawing via one of preferred channels of communication. I present to the client my Terms of Service and prices and discuss all the details of a drawing.
▶️ 8.2 After coming to an agreement the client is put in a queue and awaits information that I’m ready to start working on their commission. I send an invoice requesting the required amount of money to the client. By sending the requested money the client agrees to presented Terms of Service. I start drawing only after I receive a payment notification on PayPal.
▶️ 8.3 During the drawing process I shall provide the client with mock-ups made in Blender and Work in Progress versions of the commission. Work in Progress versions will always be smaller and in lower quality than the final product. I won’t provide Work in Progress versions for Free Rein type commissions.
▶️ 8.4 Client is encouraged to provide feedback to every WiP they receive. I’m happy to listen to all critique regarding the drawing process and I’ll try to apply all changes requested by the client.
▶️ 8.5 I preserve to right to refuse applying changes to a drawing if requested changes require huge reworks of the current drawing. Especially I won’t change the pose or lines after starting the shading process.
▶️ 8.6 If client insists on applying huge changes to a drawing that has accepted sketch/mock-up and the drawing process is already in advanced stage I may charge additional fees starting from 200 EURO. Final fee cost will depend on effort needed for me to apply the change.
▶️ 8.7 I post from time to time WiP version of commissions I’m working at on my Patreon/Subscribestar. If a client does not want to have WiPs presented to public they should inform me about it.
▶️ 8.8 Please be patient. Drawing, especially a fully detailed drawing, can take a long time even a few months. I will always try to keep all my clients updated on my commission status.
▶️ 8.9 After creative process is done the client will be provided with a high resolution version of the drawing as a JPEG or PNG file.
▶️ 8.10 I will upload the finished drawing to my Patreon/Subscribestar first. After a few days I will also upload the drawing to FurAffinity and to my social media sites.

9. Copyright and use of my art
▶️ 9.1 I preserve all rights to every commissioned artwork drawn by me, including all author’s economic rights to the drawing.
▶️ 9.2 By commissioning me to draw a character a client has the rights to, the client automatically allows me to use his/her character in the commissioned drawing. The client also allows me to use the commissioned drawing containing his/her character for commercial use such as selling prints of the commissioned drawing.
▶️ 9.3 Client can use my drawings only for non-commercial use unless I specifically grant them permission for commercial use.
▶️ 9.4 Client is allowed to upload my drawing to his/her gallery as long as he/she provides credits to the artist, link to original drawing and the uploaded version is not in higher resolution than version uploaded on the artist’s gallery.
▶️ 9.5 By creating a reference sheet of a character I allow the client who commissioned me to create that reference sheet to use the visual design of that character in any further commissions made by other artists.
▶️ 9.6 I do not allow for my artwork to be used in creation of NFT or to be used in training AI models.

10. What I won’t draw
▶️ 10.1 I won’t draw anything that violates polish/international law.
▶️ 10.2 I won’t draw extensive gore (mild gore is accepted).
▶️ 10.3 I won’t draw character reference sheets.
▶️ 10.4 I won’t try to mimic any other style (anime, line art, any specific artist style)
▶️ 10.5 I can draw NSFW only if it is artistic nudity. I draw more explicit NSFW mostly for myself. This may change in the future. I won’t draw some sexual fetishes like: scat, urination, diaper, pregnancy or inflation. Client can always ask me whether I’m OK with a certain fetish.

Privacy Policy

Your personal information I have access to
When making a PayPal payment, you provide me with certain information (which you have authorised PayPal to provide me with) such as your name, email address, postal address and payment information. When contacting me with e-mail you provide me with your e-mail address.

Why I need your information and how I use it
I rely on a number of legal bases to collect, use, and share your information such as:
◦ Information needed to provide our services, such as when I use your information to fulfil your order, to settle disputes, or to provide customer support.
◦ Information necessary to comply with a legal obligation or court order or in connection with a legal claim, such as retaining information about your purchases, if required by tax law.

Information sharing and disclosure
I share your personal information for very limited reasons and in limited circumstances. In order to fulfil my tax duty I share your name, e-mail address and payment information with my accountant. I also may collect, use, retain and share your information, if I have good faith belief that it is reasonably necessary to:
◦ respond to legal process or to government requests;
◦ enforce our agreements, terms and policies;
◦ prevent, investigate and address fraud and other illegal activity, security or technical issues;
◦ protect the rights, property and safety of our customers or others.

Data retention
I don’t directly collect your information. All your information I possess is being automatically stored either on PayPal platform or on Gmail. In case of PayPal your data retention is described within PayPal’s privacy policy. In case of Gmail I will keep conversation with you for the time of 2 years.
• In certain situations however, I may be required to retain your information longer in order to comply with our legal and regulatory obligations, to resolve disputes and to enforce our agreements. I may also need to retain your information in case of a tax control.

Transfers of Personal Information Outside the EU
At this moment I do not use any digital third party services that require the transfer of your personal information outside of the EU.

Your rights
If you reside in certain territories, including the EU, you have a number of rights in relation to your personal information. While some of these rights apply generally, certain rights apply only in certain limited cases. Those rights are as follow:
◦ Access
You may have the right to access and receive a copy of the personal information I hold about you by contacting me using the contact information.
◦ Change, restrict, delete
You may also have rights to change, restrict our use of, or delete your personal information. Absent exceptional circumstances (like where I am required to store the data for legal reasons) I will generally delete your personal information upon request.
◦ Object
You can object to our processing of some of your information based on our legitimate interests and receiving marketing messages from us after providing your express consent to receive them. In such cases, I will delete your personal information unless I have compelling and legitimate grounds to continue using that information or if it is needed for legal reasons.
◦ Complain
If you reside in the EU and wish to raise a concern about our use of your information (and without prejudice to any other rights you may have), you have the right to do so with your local data protection authority.
